Terms of Service

1. Acceptance of these Terms

By creating an account, checking the box that you agree to these Terms, or using the FreeTheAI website or API (together, the "Service"), you agree to be bound by these Terms of Service and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not create an account and do not use the Service.

You must be at least 18 years old, or the age of majority where you live if that is higher, and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" includes it.

2. What FreeTheAI is

FreeTheAI is a marketplace and gateway that routes your API requests to artificial intelligence models run by third parties ("Upstream Providers"), including independent sellers, donated keys, and commercial model providers. FreeTheAI does not create, train, or control those models.

FreeTheAI may add, change, rate-limit, suspend, or remove any model, provider, feature, free allowance, or plan at any time, with or without notice. Free access is a courtesy, not an entitlement, and may be reduced or ended at any time.

3. Your account

• You must give accurate information, use an email address you control, and verify it. Accounts whose email is not verified within 10 days of signup may be deleted without notice.
• You are responsible for everything done with your account and API keys. Keep your password and keys secret and tell us promptly through Support if you believe they were compromised.
• One person may hold one account. Creating multiple accounts to multiply free allowances, evade limits, or avoid a suspension is prohibited.

4. Acceptable use

You agree not to use the Service, directly or indirectly, to:

• violate any law or regulation, or any right of any person, including intellectual property, privacy, and publicity rights;
• generate or distribute child sexual abuse material, content that sexualizes minors, or non-consensual intimate imagery;
• harass, threaten, defraud, impersonate, or deceive any person, or run spam, phishing, or malware campaigns;
• develop weapons capable of mass casualties, or plan or promote violence or terrorism;
• attack, probe, overload, scrape, or reverse engineer the Service, its CAPTCHA, or its infrastructure, or bypass any rate limit, allowance, verification, or security measure;
• resell, share, or pool access to the Service or your API keys except as FreeTheAI expressly allows;
• use the Service in violation of the usage policies of the Upstream Provider that serves your request.

We may investigate suspected violations and may suspend or terminate accounts, revoke keys, block IP addresses, and report unlawful activity to authorities, at our sole discretion and without liability to you.

5. Your content and outputs

You are solely responsible for the prompts, files, and other input you send ("Input") and for how you use the model responses you receive ("Output"). You represent that you have all rights needed to send your Input and that it complies with these Terms.

FreeTheAI does not store the content of your prompts or of model responses. To deliver a request, your Input is transmitted to the Upstream Provider that serves it and is handled under that provider's own terms and policies.

Output is generated by third-party models, may be inaccurate, incomplete, offensive, or harmful, and may be similar to output given to others. You must evaluate Output yourself before relying on it, and you must not present it as human-generated where that would mislead. As between you and FreeTheAI, you own your Input and, to the extent permitted by law and by the Upstream Provider, the Output.

6. Third-party providers: no guarantee

Requests are fulfilled by Upstream Providers that FreeTheAI does not own or control. FreeTheAI makes no promise, representation, or guarantee about how any Upstream Provider handles your data, including whether it logs, stores, reviews, or trains on your Input or Output, where it processes data, or how long it keeps it.

FreeTheAI is not responsible or liable for any act, omission, data practice, outage, security incident, or content of any Upstream Provider. Do not send data you are not prepared to share with a third party, including secrets, credentials, or personal, health, or financial information about anyone.

7. Payments, cryptocurrency, and no refunds

ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE. BY ADDING FUNDS TO YOUR WALLET OR BUYING A PLAN, YOU AGREE THAT FREETHEAI WILL NOT REFUND ANY DEPOSIT, WALLET BALANCE, OR PLAN PURCHASE, IN WHOLE OR IN PART, EXCEPT AS STATED IN THIS SECTION OR AS REQUIRED BY A LAW THAT CANNOT BE WAIVED BY AGREEMENT.

• Cryptocurrency only. Deposits and plan purchases are paid in cryptocurrency through our third-party payment processor, whose own terms also apply to the payment. Prices are set in U.S. dollars. The processor shows the cryptocurrency amount to send, and your wallet is credited with the U.S. dollar value the processor confirms for your payment.
• Blockchain payments are irreversible. A payment is complete once it is confirmed on its blockchain, and neither FreeTheAI nor the processor can cancel or reverse it. You alone are responsible for sending the exact asset, network, amount, and address shown at checkout before the invoice expires. Funds sent to the wrong address or network, in the wrong asset, after the invoice expires, or short of the amount due may be delayed or permanently lost, and FreeTheAI is not liable for them; we may, but are not required to, try to help recover or credit them. Network, gas, and exchange fees are yours and are never refunded. FreeTheAI is not responsible for any change in the value of any cryptocurrency before or after you pay.
• No refunds for any reason, including a change of mind; unused or partly used balance or plan time; models, providers, prices, free allowances, or features that change, are rate-limited, or are removed; outages or errors of FreeTheAI or of any Upstream Provider; dissatisfaction with any Output; or suspension or termination of your account for a violation of these Terms, suspected fraud, or abuse.
• Wallet balance is prepaid credit for the Service only. It is not money, currency, a deposit account, or property. It earns no interest, has no cash value, and cannot be withdrawn, cashed out, exchanged, or transferred to another account. Plans run for the period shown when you buy them and are not prorated or cancelled early.
• Charges. Paid requests are charged from your wallet at the prices shown when each request is made. Failed requests are not charged: an amount held for a request that fails is released back to your wallet automatically, which is a release, not a refund. We may correct billing errors in either direction. You are responsible for any taxes that apply to your purchases.
• Immediate supply and withdrawal rights. Wallet credit and plan access are digital content supplied immediately after your payment is confirmed. By paying, you expressly request immediate supply and acknowledge that, where the law gives you a right to withdraw from or cancel a distance purchase, you lose that right once your wallet is credited or your plan starts. You confirm this by checking a box before each purchase, and your confirmation is recorded.
• Our limited exception. If FreeTheAI permanently shuts down the Service, or closes your account for a reason other than your violation of these Terms, suspected fraud or abuse, or a legal requirement, you may ask through Support within 60 days for the unused balance you paid for. We will return it in cryptocurrency, at its U.S. dollar value on the day we pay it, to an address you provide, less network fees. Promotional or free credit is never returned. Any other refund, credit, or accommodation FreeTheAI makes is a one-time courtesy at its sole discretion and does not change this policy.
• Fraud, reversals, and legal holds. We may hold, reverse, or forfeit balances and plans connected to fraud, stolen or illicit funds, payment reversals, sanctions or other legal requirements, or a violation of these Terms, and we may report such activity to the authorities.
• This refund policy is shown to you before you pay. You may request a written copy of it at any time through Support.

8. Donated API keys and sellers

If you donate an API key, you represent that you own it and are permitted to share it, and you authorize FreeTheAI to use it to serve other users' requests until you revoke it. You are responsible for any cost, quota use, or consequence under that provider's terms. Donations earn only the perks FreeTheAI chooses to offer, which may change at any time.

Sellers are bound by the seller terms presented during the seller application in addition to these Terms.

9. Suspension and termination

We may suspend, limit, or terminate your access, delete your account, or refuse service to anyone, at any time and for any reason, including suspected abuse, security risk, legal requirements, or inactivity. You may stop using the Service at any time and may ask us through Support to delete your account. Section 7 governs what happens to a paid wallet balance or plan when an account is suspended, terminated, or deleted. Sections that by their nature should survive termination will survive it.

10. Disclaimer of warranties

THE SERVICE, ALL MODELS, AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, FREETHEAI DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION. FREETHEAI DOES NOT WARRANT THAT THE SERVICE WILL BE AVAILABLE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY OUTPUT WILL BE CORRECT OR SAFE TO RELY ON.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FREETHEAI AND ITS OPERATORS, CONTRIBUTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICE, ANY OUTPUT, OR ANY UPSTREAM PROVIDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

FREETHEAI'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FREETHEAI IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) TEN U.S. DOLLARS. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY APPLY TO YOU ONLY TO THE EXTENT THE LAW ALLOWS.

12. Indemnification

You will defend, indemnify, and hold harmless FreeTheAI and its operators and contributors from any claim, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of your Input, your use of Output, your use of the Service, any key you donate, or your violation of these Terms or of any law or third-party right.

13. Governing law and disputes

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. Before filing any claim, you agree to contact us through Support and try in good faith to resolve the dispute informally for at least 30 days. Any claim that is not resolved must be brought exclusively in the state or federal courts located in New York County, New York, and you consent to their personal jurisdiction. To the extent permitted by law, claims must be brought individually and not as a plaintiff or class member in any class or representative proceeding.

14. Changes to these Terms

We may update these Terms. The version and effective date at the top show which version applies. When we make material changes we will give notice on the website or by email, and we may ask you to accept the new Terms. Continuing to use the Service after changes take effect means you accept them.

15. General

These Terms and the Privacy Policy are the entire agreement between you and FreeTheAI about the Service. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them. Questions about these Terms can be sent through Support in your dashboard.
